By using the Dinver application and website, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Service description

Dinver is a platform that connects food lovers with restaurants. We enable users to:

• Discover new restaurants and gastronomic experiences
• Share their food and restaurant experiences
• Track restaurant visits and earn points
• Access information about restaurants, menus and opening hours

3. User account

To use certain features, you need to create a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. User content

By posting content on Dinver (photos, reviews, comments), you retain ownership of that content, but grant us a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content on our platform and in our marketing materials.

It is forbidden to post content that is:

• Offensive, threatening or discriminatory
• False or misleading
• Violates copyrights or intellectual property rights
• Contains illegal content

We reserve the right to remove any content that violates these terms without prior notice.

5. Reward system

Dinver offers a points and rewards system for active users. We reserve the right to change the reward system rules at any time. Points have no monetary value and cannot be exchanged for money.

6. Limitation of liability

Dinver provides information about restaurants based on publicly available data and user contributions. We do not guarantee the accuracy, completeness or timeliness of this information. We are not responsible for the quality of service in restaurants.

7. Changes to terms

We reserve the right to change these Terms of Service at any time. We will notify you of significant changes via the app or email.

9. Account suspension and termination

We reserve the right to suspend, restrict, or terminate your account and access to our services at any time, without prior notice, if we believe you have violated these Terms of Service, engaged in fraudulent activity, or for any other reason we deem necessary to protect our platform, users, or verified restaurants. Upon termination, your right to use the services will immediately cease.

10. Restaurant information disclaimer

Dinver is a platform for discovering and sharing restaurant experiences. We are not responsible for the quality of food, service, hygiene, accuracy of menu information, allergens, food safety, or any injuries, illnesses, or damages that may occur during your visit to any restaurant. Restaurant information is provided by the restaurants themselves or by users and may not always be accurate or up-to-date. Always verify important information (allergens, opening hours, prices) directly with the restaurant.

11. Receipt verification and fraud prevention

By scanning receipts to verify your visits, you confirm that each receipt is authentic, represents an actual purchase you made, and has not been previously submitted. We employ fraud detection measures and reserve the right to reject receipts, remove points, suspend accounts, or take legal action against users who submit fraudulent, duplicate, or manipulated receipts.

12. Intellectual property

The Dinver name, logo, design, and all original content on our platform are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our platform content without our express written permission. Automated scraping or data extraction from our platform is strictly prohibited.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dinver, its owners, employees, and verified restaurants from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) content you post on our platform.

14. Dispute resolution and governing law

These Terms of Service are governed by the laws of the Republic of Croatia. Any disputes arising from these terms or your use of our services shall be resolved in the competent courts of Zagreb, Croatia. Before initiating any legal proceedings, we encourage you to contact us to try to resolve the matter informally.

15. Force majeure

Dinver shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
